Terms of Use

These Terms of Use ("Terms") govern your use of the House Hero mobile application and its associated services ("App"). By downloading, installing, or using the App, you agree to comply with these Terms, our Privacy Policy, Acceptable Use Policy, and any other guidelines or rules provided within the App.

The App is intended for use within Australia. If you are located outside Australia, you use the App at your own risk and responsibility, and we recommend not using it.

1. Definitions

For the purposes of this document, the following definitions apply: "You/Your" refers to the User and the person/people authorized to share the house by the Owner. "Simpro Global Pty Ltd", "Company", "We", "Our", "Ours", "Us" refer to Simpro Global Pty Ltd, the legal entity that owns and operates the House Hero App. "App", "Service" refers to the House Hero mobile application and all its associated components and services, developed and operated by Simpro Global Pty Ltd. "Terms" refers to these Terms of Use, which govern your use of the App. "User" refers to any individual who registers for or uses the App. "Account" refers to the personal account created by a User to access certain features of the App. "Data" refers to the information stored and managed by Users within the App. "Maintenance Suggestions" refers to recommendations provided by the App’s Azure AI-powered feature for maintaining items to prolong their life. "Infrastructure" refers to the Microsoft Azure hosting platform where the App is hosted. "Azure AI" refers to the artificial intelligence technology provided by Microsoft Azure and used within the App to generate maintenance suggestions. "AI Hallucination" describes the phenomenon where an AI system generates output that appears valid but is actually incorrect or nonsensical due to flawed reasoning, inaccurate training data, or insufficient context. "User Content" refers to any content or data, including but not limited to text, images, and videos, that a user uploads or inputs into the App. "Third-Party Services" refers to external services or platforms integrated with the App, such as Google Login, Sign In with Apple, Microsoft Azure, or any other APIs used for functionality. "Subscription" refers to any paid features or services within the App, including the pricing, renewal, and cancellation process, if applicable. "Maintenance Tasks" refers to specific tasks or actions suggested or created by the App, either automatically through AI recommendations or manually by the user, to maintain items in the house. "House Sharing Info" refers to the data and settings related to sharing house information with other users, including permissions and access levels. "AI Suggestions" refers to maintenance recommendations generated by the Azure AI feature, which provide guidance for managing the life cycle of items in the house. "Account Information" refers to details related to the user’s personal account, including login credentials, preferences, and any data linked to the account. "Services" refers to any support or features provided by the App, including notifications, updates, and assistance with managing house inventories. "App Updates" refers to modifications or improvements made to the App, which may include bug fixes, new features, or adjustments to existing functionalities. "Data Privacy" refers to the protection of user data and how the App collects, processes, stores, and secures personal information.

2. General Information

2.1 About the App

House Hero is a mobile application that allows registered users to manage their house inventory, record item details and warranty information, receive basic maintenance suggestions powered by Azure AI, and set up and manage maintenance tasks based on AI recommendations. This app also allows the User/Owner to share and work with any User of the App on their house items.

3. User Eligibility

3.1 Age Requirements

You must be at least 18 years old to register and use the App. By using the App, you represent and warrant that you meet this age requirement.

3.2 Account Registration

To use the App, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update this information as necessary.

3.3 Google Login

If you choose to sign up or log in using Google Login: 3.3.1 You authorize us to access your Google account information, including but not limited to your name, email address, and profile picture, to facilitate account creation and login. 3.3.2 You are responsible for ensuring the security of your Google account credentials and for all activity that occurs under your Account. 3.3.3 We are not responsible for any issues arising from the use of Google Login, including but not limited to unauthorized access or changes to your Google account. 3.3.4 For more information on how we manage your privacy, please visit our Privacy Policy

3.4 Sign In wiith Apple

If you choose to sign up or log in using Apple Login: 3.4.1 You authorize us to access your Apple account information, including but not limited to your given Name, family Name, and email address, to facilitate account creation and login. 3.4.2 You are responsible for ensuring the security of your Apple account credentials and for all activity that occurs under your Account. 3.4.3 We are not responsible for any issues arising from the use of Apple Login, including but not limited to unauthorized access or changes to your Apple account. 3.4.4 For the best experience using House Hero, we recommend sharing your email address with us during the "Sign in with Apple" process. If you choose to hide your email, we will receive a unique, random email address that forwards to your personal email. Please note that this may limit certain features and functionalities of House Hero. 3.4.5 For more information on how we manage your privacy, please visit our Privacy Policy

3.5 Personal Use

The App is intended for personal, non-commercial use only. You agree not to use the App for any commercial purposes without prior written consent from us.

4. Permitted Use

Subject to the terms of this Agreement, We hereby grant you a limited, non-exclusive, personal, revocable, non-sublicensable, and non-transferable license to: 4.1 Download and install the App on your personal devices. 4.2 Register only one account for your personal use of the App. 4.3 Create a reasonable number of Houses, Rooms/Locations, Items, Tasks, etc. 4.4 Create data about Houses, Rooms/Locations, and Items that are owned by you. 4.5 Maintain inventory of Items that are owned by you or a House Owner has authorized you to maintain on their behalf. The ownership of the data shall remain with the House Owner. 4.6 Maintain inventory of Items that are legal in your jurisdiction or for which you have the appropriate license to own or keep in your possession. 4.7 Share House Sharing Info only with users you trust. 4.8 Revoke access of any House Member from the house data you own.

5. Prohibited Activities

You must not engage in the following activities: 5.1 Illegal Activities Use the App for any illegal, unlawful, or fraudulent purposes. 5.2 Unauthorized Access Attempt to gain unauthorized access to any part of the App, its systems, or user data. 5.3 IP Engineering Engage in activities that reverse-engineer or modify the App’s intellectual property. 5.4 Interference Disrupt or interfere with the normal operation of the App, its infrastructure, or any related services. 5.5 Resource Overload Engage in activities that excessively burden the App’s infrastructure, such as automated data scraping or denial-of-service attacks. 5.6 Unauthorized Monitoring Monitor or collect data from the App without permission.

6. Security and Integrity

6.1 Account Security You are responsible for maintaining the confidentiality of your login credentials. 6.2 No Exploitation You must not exploit vulnerabilities in the App for personal or financial gain. 6.3 No Automation You must not use bots, scripts, or other automated methods to access or use the App.

7. Content Restrictions

7.1 Inappropriate Content You must not upload or share content that is obscene, hateful, or promotes violence. 7.2 Recording Illegal Items You must not use the App to record, track, or manage any items that are prohibited or illegal under applicable laws.

8. User Responsibilities

You are responsible for the following: 8.1 Accurate Information Ensure that all information entered into the App, including inventory and warranty details, is accurate and up to date. 8.2 Maintenance Compliance While the App provides maintenance suggestions, you are solely responsible for ensuring compliance with maintenance schedules and guidelines. 8.3 Incorrect Maintenance Recommendations You acknowledge that the App-generated AI recommendations could be incorrect due to a phenomenon called "AI Hallucination." You are solely responsible for ensuring compliance with item maintenance and tasks for your items. 8.4 Security of House Sharing Info If you feel that your or someone else’s House Sharing Info has been breached, notify the House Owner immediately. If you are the House Owner, disable your House Sharing immediately. 8.5 Engaging Trade Professionals You must engage trade professionals as required, but not limited to, by law, for compliance, insurance, and safety purposes.

9. Availability of the Platform

9.1 Platform Access House Hero takes all practical steps to limit interruptions to your access. However, you accept that issues outside of our control cannot be resolved by us. 9.2 Service Changes You accept that the performance and functionality of House Hero may be altered or improved from time to time. 9.3 Internet Limitations Since the internet is vast, we cannot guarantee ceaseless and error-free service, which includes any third-party services.

10. Security & Data Privacy

10.1 Data Collection We collect, use, and store user data in accordance with our Privacy Policy, which can be found at: https://info.thehousehero.app/privacy-policy. By using the App, you consent to the collection and use of your information as described in our Privacy Policy. 10.2 AI Data Usage The App uses Azure AI to provide maintenance suggestions. By using this feature, you consent to the processing of your data by Azure AI for the purposes of providing these services. 10.3 Your Responsibilities You agree not to tamper with, record, or harm the privacy and information of the App. You are solely responsible for the security of your login credentials.

11. Intellectual Property

11.1 Ownership All content, features, and functionality of the App, including text, graphics, logos, and software, are the exclusive property of ours or its licensors and are protected by intellectual property laws. 11.2 Limited License We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for its intended purpose in accordance with these Terms. 11.3 No Copying or Reproduction You may not copy, reproduce, distribute, or create derivative works of any content, features, or functionality of the App without prior written consent from us. 11.4 Intellectual Property Infringement If you believe that any content on the app infringes your intellectual property rights, please notify us at info@thehousehero.app with detailed information about the alleged infringement.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SIMPRO GLOBAL PTY LTD, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, ITS FEATURES, OR ANY LINKED SERVICES. THIS INCLUDES, BUT IS NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, SUCH AS:

THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

12.1. Specific Exclusions:

12.1.1. AI-Powered Features: All recommendations, insights, or analyses provided by the App’s AI-powered features are informational only and do not constitute professional advice. Users are solely responsible for decisions made based on this information.

12.1.2. Third-Party Services: The App integrates with third-party services (e.g., Azure). We are not responsible for disruptions, inaccuracies, or failures caused by these services.

12.2. Indemnity Obligations

Users agree to indemnify and hold Simpro Global Pty Ltd harmless from any claims, liabilities, or damages arising from their misuse of the App or violations of these Terms.

12.3. Legal Constraints

NOTHING IN THIS SECTION LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW, INCLUDING BUT NOT LIMITED TO LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR BREACH OF EXPRESS INDEMNITY OBLIGATIONS.

By using the App, you acknowledge and accept these limitations as a condition of access and use.

13. Disclaimer of Warranties

YOU UNDERSTAND THAT WE CANNOT AND DO NOT GUARANTEE OR WARRANT THAT FILES AVAILABLE FOR DOWNLOADING FROM THE INTERNET OR THE APP WILL BE FREE OF VIRUSES OR OTHER DESTRUCTIVE CODE. YOU ARE RESPONSIBLE FOR IMPLEMENTING SUFFICIENT PROCEDURES AND CHECKPOINTS TO SATISFY YOUR PARTICULAR REQUIREMENTS FOR ANTI-VIRUS PROTECTION AND ACCURACY OF DATA INPUT AND OUTPUT, AND FOR MAINTAINING A MEANS EXTERNAL TO OUR APP FOR ANY RECONSTRUCTION OF ANY LOST DATA.

TO THE FULLEST EXTENT PROVIDED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, MOBILE DEVICE, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE APP, ITS FEATURES, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEBSITE LINKED TO IT.

YOUR USE OF THE APP, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP IS AT YOUR OWN RISK. THE APP, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

NEITHER SIMPRO GLOBAL PTY LTD NOR ANY PERSON ASSOCIATED WITH THE COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE APP. WITHOUT LIMITING THE FOREGOING, NEITHER SIMPRO GLOBAL PTY LTD NOR ANYONE ASSOCIATED WITH THE COMPANY REPRESENTS OR WARRANTS THAT THE APP, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR APP OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE APP OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PROVIDED BY LAW, SIMPRO GLOBAL PTY LTD HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.

14. Termination of Access

14.1 Right to Suspend or Terminate Access We reserve the right to suspend or terminate your access to the App at any time for any reason, including a breach of these Terms. 14.2 Survival of Accrued Rights Termination or suspension of your access will not affect any accrued rights, indemnities, or other provisions of these Terms that by their nature are intended to survive such termination or suspension. 14.3 Deletion or Anonymization of Content Upon termination or suspension of your account, you agree that all information and content associated with your account may be permanently deleted or anonymized at our discretion. 14.4 Termination of the App We reserve the right to discontinue the App or any part thereof at any time, with or without notice. In the event of such termination, we will provide reasonable notice where possible and may, at our discretion, provide a method for you to retrieve your data. However, we are not obligated to do so.

15. Dispute Resolution

15.1 Negotiation In the event of a dispute, you agree to first attempt to resolve the dispute informally by contacting us at info@thehousehero.app. 15.2 Mediation and Arbitration If the dispute cannot be resolved through negotiation, it shall be submitted to mediation and then binding arbitration in Western Australia. 15.3 Exceptions Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction in cases of urgency or to protect intellectual property rights.

17. Communication and AI Suggestions and Alerts

By using the App, you agree to receive important communications, such as one time code, account alerts, App updates, AI suggestions, and critical operational messages, to ensure the smooth functioning of the App. These communications are integral to the App experience and cannot be opted out of.

18. Amendments of Terms

18.1 Updates We may update these Terms from time to time. Any changes will be effective upon posting the revised Terms in the App. 18.2 Notice Updates will be posted in the App or on our website. We will send notices regarding significant updates either via the App or the email address associated with your account.

19. Governing Law

19.1 Legal Compliance These Terms are governed by the laws of Australia, and any disputes arising under these Terms shall be resolved in accordance with Australian law. 19.2 Jurisdiction Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.

20. Miscellaneous Provisions
